1. Acceptance of Terms
1.1 By accessing or using buyersagents.com.au, including its website, applications, tools, and services (collectively, the "Platform"), you agree to be bound by these Terms & Conditions ("Terms").
1.2 These Terms apply to all users, including Reviewers, Agents, and subscribers. If you do not agree, you must not use the Platform.
2. Services Provided
2.1 The Platform enables:
- Consumers (“Reviewers”) to search for, rate, and review buyer’s agents;
- Buyer’s Agents (“Agents”) to claim, manage, and promote professional profiles;
- Access to free and paid plans, including premium subscriptions with additional tools, visibility, and reporting.
2.2 We do not act as a real estate agency or buyer’s agent, and we do not verify or endorse the performance of any Agent.
3. Accounts
3.1 To access certain features, you must create an account. You agree to provide accurate, current, and complete information.
3.2 You are responsible for keeping your login secure and for all activity under your account.
3.3 Accounts may be suspended or terminated if you breach these Terms.
4. Free Profiles
4.1 Feature Limitations: Free profiles on buyersagents.com.au include limited functionality. Your profile will not display your email address, phone number, or any other direct contact information. You must not attempt to bypass these limitations or otherwise circumvent the features available only to users on a paid Professional Plan.
4.2 Prohibited Conduct: You agree not to post, embed, or reference external contact details, links, or any workaround designed to direct users outside the platform for contact or lead generation. Any attempt to circumvent platform rules or paid features may result in your profile being suspended or permanently removed.
4.3 Profile Photo Requirements: All profiles must include a clear, professional profile photo that accurately represents you. buyersagents.com.au may review profile photos at any time to ensure they meet platform standards. Your profile may be unpublished, suspended, or edited at our discretion if your photo is deemed inappropriate, misleading, poor quality, or otherwise not aligned with our professional standards.
4.4 Ongoing Compliance: By maintaining a free profile, you agree to comply with all platform requirements and updates. Failure to follow these terms may result in restrictions, removal of visibility, or deactivation of your profile.
5. Reviews and Content
5.1 Reviews must be honest, accurate, and based on genuine experiences.
5.2 You must not submit content that is false, defamatory, misleading, offensive, discriminatory, harassing, or otherwise unlawful.
5.3 We may remove or refuse to publish content at our discretion.
5.4 By submitting content, you grant Haystack Technologies Pty Ltd trading as buyersagents.com.au a perpetual, royalty-free licence to use, display, reproduce, and distribute your content worldwide.
6. Data Ownership and Use
6.1 All Platform data, including but not limited to reviews, ratings, profiles, analytics, and aggregated insights, are owned by Haystack Technologies Pty Ltd trading as buyersagents.com.au.
6.2 Users retain the right to access, download, and share their own data (for example, reviews they have written or information in their own Agent profile).
6.3 By using the Platform, you consent to our collection, storage, and use of your data in accordance with our Privacy Policy.
7. Subscriptions, Fees, and Payments
7.1 Certain services are available under paid subscription plans.
7.2 Currency: All fees are stated and charged in Australian dollars (AUD) and are inclusive of Goods and Services Tax (GST) where applicable.
7.3 Billing: Subscriptions are billed in advance on a recurring basis (monthly or annually, depending on your plan).
7.4 Renewals: Plans automatically renew unless cancelled at least [7 days] before the next billing date.
7.5 Cancellations: You may cancel at any time, but no pro-rata refunds are provided unless required under Australian Consumer Law.
7.6 Payment Methods: You authorise us to charge your nominated payment method for all fees associated with your subscription.
7.7 Price Changes: We may adjust subscription fees with [30 days'] prior notice.
8. Intellectual Property
8.1 All intellectual property in the Platform (including software, design, logos, and trademarks) is owned by or licensed to Haystack Technologies Pty Ltd trading as buyersagents.com.au.
8.2 You may not copy, reproduce, modify, or distribute any part of the Platform without written permission.
9. Disclaimer and Limitation of Liability
9.1 We provide the Platform on an "as is" and "as available" basis.
9.2 We do not warrant that: (a) reviews or ratings are accurate, complete, or reliable; (b) the Platform will be uninterrupted or error-free.
9.3 To the maximum extent permitted by law, we disclaim liability for any loss, damage, claim, or expense arising out of your use of the Platform.
9.4 Nothing in these Terms excludes your rights under the Australian Consumer Law.
10. Indemnity
You agree to indemnify and hold harmless Haystack Technologies Pty Ltd trading as buyersagents.com.au from any claim, cost, or liability arising from your breach of these Terms, your misuse of the Platform, or your submitted content.
11. Termination
11.1 We may suspend or terminate your account immediately if you breach these Terms.
11.2 You may terminate your account at any time by following instructions in your account settings.
12. Complaints and Dispute Resolution
12.1 If you have a complaint about content, an Agent profile, or a subscription, please contact us at support@buyersagents.com.au.
12.2 We will review complaints in good faith but are not obliged to mediate disputes between Reviewers and Agents.
12.3 Before commencing legal proceedings, parties agree to attempt informal resolution in good faith.
13. Governing Law
13.1 These Terms are governed by the laws of Queensland, Australia.
13.2 You submit to the exclusive jurisdiction of the courts of Queensland for any dispute arising under these Terms.
